By accessing or using SecurityChecks ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

SecurityChecks provides automated security scanning and analysis tools for software applications. Our Service includes:

  • Static security analysis of source code
  • Security invariant verification
  • CI/CD integration tools
  • Security findings management
  • Team collaboration features

3. User Accounts

3.1 Account Creation

You must create an account to use most features of the Service. You agree to provide accurate, current, and complete information during registration.

3.2 Account Security

You are responsible for maintaining the security of your account credentials and API keys. Notify us immediately of any unauthorized access to your account.

3.3 Account Termination

We may suspend or terminate your account if you violate these Terms or engage in fraudulent or abusive behavior.

4. Subscription and Billing

4.1 Free and Paid Plans

We offer free and paid subscription plans. Paid plans provide additional features, higher usage limits, and priority support.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will continue to have access to paid features until then.

4.4 Price Changes

We may modify pricing with 30 days' notice. Price changes will apply to the next billing cycle after the notice period.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Scan code that you do not have permission to analyze
  • Share API keys or account credentials with unauthorized users
  • Exceed your plan's usage limits through automation or abuse
  • Reverse engineer or attempt to extract source code from the Service
  • Use the Service to develop competing products

6. Intellectual Property

6.1 Our Content

The Service, including its design, features, and documentation, is owned by SecurityChecks and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

6.2 Your Content

You retain ownership of your code and data. By using the Service, you grant us a limited license to process your code for the purpose of providing security analysis.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL DETECT ALL SECURITY VULNERABILITIES OR THAT YOUR CODE WILL BE SECURE AFTER USING OUR SERVICE.

SecurityChecks is a tool to assist with security analysis but does not replace professional security audits, penetration testing, or secure development practices.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECURITYCHECKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or revenue
  • Loss of data
  • Security breaches in your applications
  • Business interruption

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless SecurityChecks from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect availability. We will provide notice of planned downtime when possible.

11. Data Processing

Our processing of your data is governed by our Privacy Policy. By using the Service, you consent to such processing.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
